Hugo Armendariz, a Mexican national, arrived in the United States when he was two years old and has been a legal permanent resident since he was eight years old. His family and daughter are US citizens. He was deported following an earlier conviction for a drug related offense and was found ineligible for a waiver based on a retroactive application of the Antiterrorism and Death Penalty law, making those guilty of aggravated felonies ineligible for humanitarian waivers. The Commission found the case admissible for consideration.
