Tyrone Dacosta Cadogan v. Barbados (Admissibility Decision) IACHR (4 March 2008) Report No. 7/08

Tyrone Dacosta Cadogan was convicted of murder and sentenced to a mandatory death penalty under domestic law.  Due to his drug and alcohol dependency, he argued that his diminished responsibility was not presented to the jury for consideration and resulted in an unfair trial in combination with lack of independent psychiatric assessment and effective legal aid.  The Commission held that the case was admissible and they would consider the additional potential violation of right to life arising from the mandatory application of a death sentence.
