Favela Nova Brasilia v. Brazil (Admissibility Decision) IACHR (25 September 2008) Report No. 78/98

Fourteen individuals were killed by police officers undertaking a drug raid in a shantytown of Nova Brasilia.  The petitioners alleged that despite opening an investigation, the State has failed to uphold the duty to investigate alleged violations of the right to life.  The State held that an investigation was underway and the Commission held that in light of the irregularities alleged, the time elapsed (3 years) and since the events engaged the right to life, the case was admissible.
