Gabriel Oscar Jenkins, an Argentine national, was detained and charged with drug trafficking based on alleged fabricated evidence. He was detained in pre-trial detention in accordance with domestic criminal code for more than three years. During this time, he was refused conditional release based on the drug-related nature of his offense. The Commission held the case was admissible as all domestic remedies had been exhausted.
