Vanyan v Russia, ECHR (2005)

Date: 15 December 2005

The applicant, Mr. Grigoriy Vanyan, is a Russian national who was arrested in 1998 on allegations of drug possession and sell, and was sentenced to 7 years of imprisonment. The applicant has appealed unsuccessfully. In 2000 the Presidium of Moscow City Court reviewed the case and has modified the previous judgement to 2 years of imprisonment due to findings that the applicant did not have intention to re-sell drugs. The applicant complains that he was not informed on the court hearings of his appeal and did not participate in it. The applicant relies on the right to a fair trial.
