J.S.CH. and M.G.S. were discharged from the military allegedly based on a discriminatory military practice of discharging those with HIV/AIDS.  Upon discharge, they claimed their ability to access HIV/AIDS medicines was impeded.  The Commission, in examining the merits of the application, held they were competent to hear the case in relation to suspected violations of right to fair trial, non-discrimination, humane treatment, equal protection before the law and to privacy.
