Mr. Munoz Guzman, an active member of the Mexican military, disappeared in 1993.  The petitioners held that his disappearance followed disagreements he had with his superior officers regarding information he had on drug trafficking in the region of his patrol (Ciudad Juarez) and threats he was receiving connected with that information.  While the Commission held that evidence was not sufficient to support the claim of a forced disappearance, the State still failed in its duty to investigate the allegation, citing the ineffective and unduly delayed nature of the investigation.
