Report of the International Narcotics Control Board for 2007: The Principle of Proportionality and Drug-Related Offences, INCB (2008)

This article is an excerpt from 2007 INCB Annual Report. It discusses the principle of proportionality through the prism of drug control. The discussion starts with overview of the principle of proportionality and its scope. Further, the principle is reviewed within the framework of the international drug control conventions. The third part of the article addresses the principle of proportionality for the purpose of prosecution, sentencing and possibility of alternative measures. The article also considers the principle of equality before the law and cooperation between justice and healthcare systems. In the conclusion recommendations on how to improve observance of the principle of proportionality in the drug control regime are presented.
