Abstract

The authors reflect on the significance of the judicialisation of the right to health in Brazil. They describe the health trend in Brazil wherein people turn to courts to access prescribed drugs. They trace the evolution of health laws in Brazil, including those that mandate the establishment of a national health care system and an access to antiretroviral treatments. The authors also argue that the judicialisation of the right to health marks a new chapter in the history of pharmaceutical access in the country.
